Terms of Use.
These Terms of Use (the "Terms") govern access and use of the website podiocapital.com (the "Site"), operated by Podio Capital. By accessing or using the Site, you agree to be legally bound by these Terms. If you do not agree, please refrain from using the Site.
1. About Podio Capital
Podio Capital is a real estate developer and brokerage based in Mexico City, dedicated to structuring, designing and executing real estate investment projects since 2007. We operate under two sub-brands: AVORA (urban developments) and FAISANO (vacation developments), as well as our associated brokerage Podio Realty.
2. Informational nature of the Site
Content published on the Site is for informational and presentation purposes only. Information about projects, locations, specifications, renderings, photographs, prices or availability does not constitute a binding offer or contractual commitment.
Any real estate transaction, investment or commercial relationship will require the signing of corresponding contracts and will be subject to the particular conditions agreed in writing between the parties.
3. Intellectual property
All content on the Site —including but not limited to texts, photographs, architectural renderings, plans, logos, trademarks, graphic design, source code and structure— is the property of Podio Capital or has the corresponding licenses, and is protected by Mexican and international intellectual property laws.
Reproduction, distribution, modification, public communication or any other form of exploitation of Site content is strictly prohibited without prior written authorization from Podio Capital.
The trademarks Podio Capital, AVORA, FAISANO and Podio Realty, as well as their respective logos, are registered trademarks or pending registration in favor of Podio Capital.
4. Renderings and photographs
Images shown on the Site include architectural renderings, photographs of completed projects, and photographs of operating spaces. Renderings are approximate representations for illustrative purposes and may differ from the final appearance of the construction, which may be subject to modifications due to technical, regulatory, design or construction requirements.
5. Permitted use
You agree to use the Site only for lawful purposes and in accordance with these Terms. The following is prohibited:
- Using the Site for fraudulent, deceptive purposes or to impersonate identity
- Attempting unauthorized access to restricted areas, servers or databases
- Interfering with normal operation of the Site through viruses, bots, mass scraping or other means
- Using Site content to create derivative databases, services or publications without authorization
- Sending mass communications, spam or malicious information through the contact form
6. Third-party links
The Site may contain links to websites operated by third parties (including social networks and our associated brokerage). Podio Capital does not control or assume responsibility for the content, privacy policies or practices of such third parties. The inclusion of any link does not imply endorsement of its content.
7. Limitation of liability
The Site is provided "as is". Podio Capital makes reasonable efforts to keep information up to date but does not guarantee the accuracy, completeness or currency of published data.
To the maximum extent permitted by applicable law, Podio Capital will not be liable for direct, indirect, incidental or consequential damages arising from the use or inability to use the Site.
8. Privacy and personal data
The processing of personal data collected through the Site is governed by our Privacy Notice, which is an integral part of these Terms.
9. Modifications to the Terms
Podio Capital reserves the right to modify these Terms at any time. Modifications will take effect upon publication on the Site. Continued use of the Site after modifications implies acceptance of the new Terms.
10. Applicable law and jurisdiction
These Terms are governed by the laws of the United Mexican States. For any dispute arising from them, the parties expressly submit to the jurisdiction of the competent courts of Mexico City, waiving any other jurisdiction that may correspond to them.
